Terms of Service

These Terms of Service (“Terms”) govern your use of the Poest website at https://poest.site, the Poest web app and the Poest mobile apps (together, the “Service”), operated by Serhii Bilotil (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Poest helps you plan content, prepare posts (including with AI assistance), and publish them to social media accounts that you own or manage, such as Instagram, Threads, Facebook Pages, TikTok, LinkedIn and X. Features may change over time, and some features may be in early access.

2. Your account

• You must be at least 16 years old and able to enter into a binding agreement.
• Give accurate information and keep your password secure. You are responsible for activity in your account.
• Tell us right away at contact@moderncv.io if you suspect unauthorized access.

3. Connecting social media accounts

You may connect only accounts that you own or are authorized to manage. When you connect an account, you authorize Poest to publish the content you schedule and to read the data needed to show its status and statistics. Your use of each network is also governed by that network’s own terms and policies (for example the Instagram Terms of Use, Meta Terms, Threads Terms, TikTok Terms of Service, LinkedIn User Agreement and X Terms of Service). We are not responsible for the networks’ decisions, outages, limits or changes to their APIs, which may affect publishing.

4. Your content

You keep all rights to the texts, images, videos and other content you upload or create in Poest (“Your Content”). You grant us a limited, worldwide, non-exclusive licence to host, store, process, transmit and display Your Content only as needed to operate the Service for you, including sending it to the networks and AI providers you choose. This licence ends when you delete the content or your account, except for content already published on a social network at your request.

You confirm that you have the necessary rights to Your Content and that publishing it does not violate any law or anyone’s rights.

5. AI-generated content

AI features generate suggestions automatically and may produce inaccurate, incomplete or inappropriate results. You are responsible for reviewing AI output before publishing it. Subject to the AI provider’s terms, the output you generate is yours to use.

6. Acceptable use

You agree not to use the Service to:

• publish spam, misleading content, or content that is illegal, hateful, harassing, sexually exploitative or violent;
• infringe copyright, trademarks, privacy or other rights;
• violate the rules of any connected social network, including rules on automation and inauthentic behaviour;
• access accounts or data you are not authorized to access;
• interfere with, overload, reverse engineer or try to bypass the security of the Service;
• resell or provide the Service to others without our written permission.

We may remove content, or suspend or close accounts, that break these rules.

7. Fees

The Service is currently free of charge. If we introduce paid plans, we will tell you in advance, and you will not be charged unless you choose a paid plan.

8. Availability and changes

We work to keep the Service reliable, but it is provided “as is” and “as available”. We do not guarantee that it will be uninterrupted, error-free, or that every scheduled post will be published at the exact time, because publishing depends on third-party networks. We may change, suspend or discontinue features, and will give reasonable notice of significant changes where possible.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data, followers or business opportunities, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or 100 euros. Nothing in these Terms limits liability that cannot be limited by law.

10. Termination

You can stop using the Service and delete your account at any time (see Data Deletion). We may suspend or end your access if you breach these Terms or if required by law. Sections that by their nature should survive termination will survive.

11. Privacy

How we handle personal data is described in our Privacy Policy.

12. Governing law

These Terms are governed by the laws of Ukraine, without prejudice to any mandatory consumer protection rights you have under the law of your country of residence. Disputes will be resolved by the competent courts of Ukraine, unless the law of your country gives you the right to bring a claim locally.

13. Changes to these Terms

We may update these Terms. We will post the new version here with a new date and notify you of significant changes in the app or by email. If you keep using the Service after the changes take effect, you accept the updated Terms.
